§ 1-15. Miscellaneous ordinances not affected by Code.

(a)

Nothing in this Code or the ordinance adopting this Code shall affect:

(1)

Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of this Code.

(2)

Any prosecution, suit or proceeding pending or any judgment rendered prior to the effective date of this Code.

(3)

Any ordinance or resolution promising or guaranteeing the payment of money for the town or authorizing the issue of any bonds of the town or any evidence of the town's indebtedness or any contract or obligation assumed by the town.

(4)

Any annual tax levy.

(5)

Any right or franchise conferred by ordinance or resolution of the town on any person.

(6)

Any ordinance adopted for purposes which have been consummated.

(7)

Any ordinance which is temporary, although general in effect, or special, although permanent in effect.

(8)

Any ordinance relating to the salaries of the town officers or employees.

(9)

Any ordinance annexing territory to the town.

(10)

Any ordinance naming, renaming, opening, accepting or vacating streets or alleys in the town.

(11)

Any land use or zoning ordinance or ordinance rezoning or amending any official zoning map.

(12)

Any administrative ordinances of the town not in conflict or inconsistent with this Code.

(13)

Any ordinance adopting the budget or any appropriation ordinance.

(14)

Any ordinance levying or imposing taxes.

(15)

Any ordinance prescribing through streets, parking and traffic regulations, speed limits, one-way traffic, limitations on load of vehicles or loading zones.

(16)

Any ordinance establishing and prescribing the street grades of any street.

(17)

Any ordinance providing for local improvements and assessments for such improvements.

(18)

Any ordinance regarding plats or subdivisions.

(19)

Any ordinance excluding territory or any ordinance extending the boundaries of the town.

(20)

Any ordinance establishing positions, classifying positions, establishing pension or employee benefits or any personnel regulations or indemnifications policies, or otherwise related to employees.

(21)

Any ordinance on investment and other financial policies or establishing investment or reinvestment zones.

(22)

Any ordinance calling an election.

(23)

Any ordinance authorizing agreements.

(24)

Any ordinance relating to the acquisition of lands by the town by condemnation proceedings.

(25)

Any ordinance levying a fee, rate, deposit or charge.

(26)

Any ordinance adopting or amending the comprehensive plan.

(27)

Any ordinance adopted by reference by any section of this Code and not included in this section.

(28)

Any ordinance establishing specifications or requirements for streets, utilities or drainage, etc.

(29)

Any temporary or special ordinance.

(b)

All such ordinances are recognized as continuing in full force and effect to the same extent as if published at length in this Code. All ordinances are on file in the town clerk's office.
