§ 1-11. Prosecutions, fines and penalties generally.

  • (a)

    All prosecutions for violation of ordinances of the town shall run in the name of the town. The cost in all prosecutions shall correspond to the costs imposed by the trial judge under the law, and shall be paid over to the town treasurer to be mingled with the general funds of the town.

    (b)

    In case of the failure on the part of the offender to pay the fine and costs imposed for the violation of any ordinance of the town and such failure is not based upon an inability to pay, the trial judge may cause the offender to be imprisoned in the jail of the town for any term not exceeding 12 months, unless such fine and costs are sooner paid.

    (c)

    If a person liable to a fine or penalty is an infant, the trial judge before whom the case is tried may, in his discretion, impose a fine either on him, his parent or his guardian.
